REMARKS: On June 20, 2023, the Board approved a Special Warranty Deed, recorded as Official Records Document No. 20230361366, as required to fulfill the conveyance obligations associated with the Polo Glen at Lake Betty Developers Agreement, recorded as Official Records Document No. 20200557266 and approved by the Board on September 22, 2020.
Subsequent review determined that the legal description contained in the 2023 Special Warranty Deed was incorrect. A Corrective Special Warranty Deed is therefore necessary to correct the legal description and accurately reflect the property intended to be conveyed pursuant to the Developers Agreement.
Additionally, a portion of the property that was required to be conveyed pursuant to the Developers Agreement was inadvertently omitted from the 2023 conveyance. A separate Special Warranty Deed is being presented to convey the omitted portion of the property.
The Grantor shall be responsible for all recording fees associated with the Corrective Special Warranty Deed and the additional Special Warranty Deed.
Approval of these documents will correct the previously recorded conveyance and complete the required conveyance contemplated by the Polo Glen at Lake Betty Developers Agreement.
