PROJECT: SkyBuilders 4 All, Inc.
PURPOSE: In March of 2023, the Governor signed Senate Bill 102, the Live Local Act, amending section 125.379, Florida Statutes, which requires each county to prepare an inventory list every three years of real property to which the county holds a fee simple title and is appropriate for use as affordable housing. As a result of the Live Local Act, Orange County’s most recent property inventory list was adopted on October 24, 2023, via Resolution No. 2023-M-49 and includes 25 lots identified as appropriate for use as affordable housing and provides for the authority for the Real Estate Management Division to transfer the deeds to those properties. The Statute provides five ways in which the County may dispose of these properties, including the donation of the property to a non-profit housing organization for the construction of permanent affordable housing. The County additionally established the surplus lot program as one of the strategies of the Affordable Housing Trust Fund (AHTF).
On March 5, 2024, a Request for Applications was issued to such non-profit housing organizations as part of the surplus lot program. Applications were accepted through April 9, 2024, and a committee comprised of Housing and Community Development Division and Planning Division staff reviewed the applications using criteria to evaluate organizational capacity and experience, proposed project scope, target population, project financing and timeline, and project sustainability features. A total of four non-profit agencies were recommended to receive 11 of the county-owned lots. Recommendations were presented to the Affordable Housing Advisory Board on June 12, 2024, and the Affordable Housing Advisory supported the recommendations.
The County will donate and convey its interest to certain properties pursuant to the Agreement with SkyBuilders 4 All, Inc. to ensure that affordable, owner-occupied residences are developed and constructed on the donated properties. Upon completing the development and construction of affordable housing units, SkyBuilders 4 All, Inc., will sell the housing units to low- or moderate-income persons or households.
The Agreement also authorizes the County to reimburse SkyBuilders 4 All, Inc. for certain development costs and fees in an amount not-to-exceed $30,000 per housing unit from the AHTF. Additionally, all eligible homebuyers will be encouraged to apply for the County's Down Payment Assistance Program. A list of the properties being donated to SkyBuilders 4 All, Inc. is below. A total of two housing units will be constructed in accordance with the Agreement.

This request also provides for the execution of the associated County Deeds for each parcel and authorization for the Real Estate Management Division to perform all actions necessary and incidental to closing to facilitate the donation and conveyance of the properties. The County Attorney's Office has reviewed the Agreement as to form.
