Approval and execution of (1) Memorandum of Understanding for Engineering Design Service Fee Related to the International Drive Area Utility Undergrounding by and between Orange County and International Drive Business Improvement District and (2) Resolution of the Orange County Board of County Commissioners regarding the Evaluation of Proposal for Undergrounding Utilities in the International Drive Area, authorizing payment in the amount of $8,468 to Duke Energy and requesting reimbursement in the amount of $4,234 from the International Drive Business Improvement District for Engineering Design Services. PURPOSE:
Business owners along International Drive, represented by the International Drive Business Improvement District (District), have asked the County to evaluate the feasibility of a future project to underground overhead utility lines along International Drive between north of Sand Lake Road and the City of Orlando/County line.
Duke Energy has identified the project scope and submitted a non-binding letter dated June 25, 2026, requesting an Engineering Design Service Fee to prepare utility conversion design plans, identify the necessary easements, coordinate project obligations, and prepare a binding cost estimate and agreement for the County’s and the District’s evaluation.
The District has agreed to share the cost of the Engineering Design Service Fee of $8,468 equally with the County. The County will initially pay the full Engineering Design Service Fee and seek reimbursement from the District for fifty percent of the cost.
The terms and conditions of the agreement between the County and the District are expressed in the Memorandum of Understanding.
The Resolution seeks the Board’s authority for the County to pay Duke Energy the Engineering Design Service Fee and seek reimbursement of fifty percent of the cost from the District.
Public Works Engineering Division, Neighborhood Services Division, Risk Management Division, and the County Attorney’s Office have reviewed the agreement and found the terms and conditions acceptable.
