PURPOSE: Orange County’s EMS Division/Office of the Medical Director (“EMS”) requests the approval of the application to renew the Certificate of Public Convenience and Necessity (“COPCN” or “Certificate”) for Affordable Transport, Inc. (“ATI”) to provide Advanced Life Support (“ALS”) and Basic Life Support (“BLS”) interfacility transport services in Orange County, Florida. ATI has submitted the attached application requesting the renewal of ATI’s COPCN which has been in effect since 2019 and was modified and expanded in 2022. On March 1, 2024, ATI entered into a Management Services Agreement and an Asset Purchase Agreement with MedFleet, LLC (“MedFleet”) pursuant to which MedFleet agreed to provide certain management services for ATI like billing, personnel, asset management, licensing, and medical records management, and ATI agreed to sell certain assets and equipment to MedFleet like vehicles, contracts, and intellectual property rights, respectively. On September 5, 2024, ATI submitted an application to Orange County EMS to renew ATI’s COPCN. EMS reviewed ATI’s renewal application and determined that ATI’s agreements with MedFleet constituted a substantial and material change in the status of ATI. In accordance with Section 20-99 of the Orange County Code, EMS forwarded ATI’s renewal application to the Orange County Emergency Medical Services Advisory Council (“EMSAC”) for review and recommendation. On October 23, 2024, EMSAC held a public hearing on ATI’s renewal application. Orange County EMS provided background information on ATI’s renewal application and the agreements between ATI and MedFleet. EMSAC provided the applicant and the public with an opportunity to comment and be heard. MedFleet provided a history of its company and explained its agreement with ATI to provide management services. EMSAC confirmed that the agreements do not transfer or assign ATI’s COPCN to MedFleet. EMSAC voted to recommend approval of ATI’s COPCN renewal application and submitted its Report and Recommendation to the Board of County Commissioners, through EMS, a copy of which is attached to this Memorandum. EMS also recommends that the Orange County Board of County Commissioners renew ATI’s COPCN.
