PURPOSE:
The attached Interlocal Agreement (ILA) concerning the Kirkman Road Extension is intended to memorialize the respective responsibilities of Orange County and the Shingle Creek Transit and Utility Community Development District (District) as it relates to the maintenance and operations of the Kirkman Road Extension. Pursuant to the Roadway and Infrastructure Agreement (Kirkman Road Extension - dated December 23, 2019), pertinent segments of the Extension (Segment 1 and Segment 2) are to be conveyed from Universal to Orange County (inclusive of transit and ancillary infrastructure). Thereafter, the applicable sections of the road will then comprise part of the County public roadway system.
Upon conveyance of Kirkman Road to the County, the District will assume inspection and maintenance services for the management, operations, and maintenance of the aesthetic components of the infrastructure as defined in Exhibit C of the ILA. The cost of the aesthetic inspection and maintenance services are to be borne solely by the District.
Similarly, the District is to also assume inspection and maintenance service for the structural elements of the infrastructure (identified in Exhibit D of the ILA). In the event repairs or replacement work is needed for structural components of the roadway, following the County’s approval of the work to be performed, the District and contractors may proceed with appropriate services related to inspection and maintenance requirements and repairs. Costs for the structural inspection services will be borne by the District and necessary repair work will be split equally between the County and the District.
In respect to the County maintained improvements, the County will be solely responsible for the inspection, management, operation and maintenance costs. The County maintained improvements include; maintenance of the asphalt pavement, roadway base/subbase, curbs, separators, ramps, pavement markings, specific stormwater collection systems, signage, signalization and elements of the pedestrian crossings. The County maintained improvements are identified in Exhibit E of the ILA.
As to the transit lanes and as outlined in a Bus Rapid Transit (BRT) Controlled Access Feasibility Study, a three-tier approach in operational implementation and management is anticipated. The District will be fully responsible for the Tier 1 improvements which are authorized pursuant to this ILA, including the maintenance and repairs. However, prior to the implementation of Tier 2 and Tier 3 which must be mutually agreed upon between the County and District, this Interlocal Agreement would need to be amended to address unique issues including but not limited to inspection, maintenance, repair, signage, lighting, signals, electronic data receiver and cameras. Tier 2 improvements would entail the installation of active intelligence systems providing automated messaging/enforcement and illuminated signage. Tier 3 improvements would include a series of physical automatic barrier gate systems to control intrusions into the BRT lanes.
The ILA addresses a variety of other general provisions, including access, District procurement, and general coordination.
