PROJECT:
N/A

PURPOSE: As part of their infrastructure improvements, Hamlin Partners at Silverleaf, LLC (the “Developer”) commenced constructing improvements at and near the intersection of Avalon Road and Porter Road under Orange County Permit number 22-E-095 (“Permit”) and based on the Town Center West (Silverleaf) Road Network Agreement.  Roadway Plans for the Permit required relocating two Conserv II Air Release Valves and two Conserv II Pump Out structures within the right-of-way (ROW) and abandoning one Conserv II Pump Out structure (the “Conserv Utility Work”). The Roadway Plans for the Permit also required relocating two County-owned Air Release Valves (the “County Utility Work”). All Conserv Utility Work and County Utility Work are within the County ROW.

This project also supports the Hamlin Town Center Orlando College of Osteopathic Medicine (OCOM), and Porter Road must remain open to traffic for access to the new OCOM Medical College in the Silverleaf Development on the west side of the Porter Road Extension.  Because of this, the project was pulled from the CIP Horizon West Town Center Project for the widening of CR 545 (Avalon Road) as an advanced/accelerated project by the Developer.

This agreement provides for reimbursement of the County Utility Work and the Conserv Utility Work, and follows the Orange County Utilities’ standard reimbursement agreement language with a retroactive statement to the plan approval date. The construction costs associated with the County Utility Work to be paid by Orange County under this agreement are limited to a total payment obligation amount of $35,092.56. As the City of Orlando (the “City”) owns 50% of Conserv II infrastructure, the City is also a party to this agreement and will pay 50% of the total reimbursement amount for the Conserv Utility Work, with the associated construction costs under this agreement limited to a total payment obligation amount of $75,772.09.

Therefore, the construction costs of the utility improvements to be paid by Orange County under this agreement are limited to a total payment obligation amount of $72,978.60, consisting of up to $35,092.56 for the County Utility Work and up to $37,886.04 for Orange County’s 50% share of the Conserv Utility Work. The construction costs of the utility improvements to be paid by the City under this agreement are limited to a total payment obligation amount of $37,886.05.

The County Attorney’s Office and Risk Management Division reviewed the agreement and find it acceptable as to form. Utilities Department staff recommends approval.
