Approval to award Invitation for Bids Y24-1036-CR, Roadbase, Asphalt, Curb, Gutter & Miscellaneous Concrete Repair, to the low responsive and responsible bidder, American Persian Engineering and Construction LLC, in the estimated contract award amount of $2,872,900 for a one-year term. Further request Board authorization for the Procurement Division to renew the contracts for two additional one-year terms.([Public Works Department Roads and Drainage Division] Procurement Division)

PROCUREMENT:
Work under this contract shall consist of providing all labor, materials, equipment and incidentals necessary to perform roadway road base, asphalt, curbs, gutters, sidewalks and other miscellaneous concrete repairs to include but not limited to the removal, replacement, repair, hauling, grading, stabilization and sodding at designated locations within Orange County.
FUNDING:
Funding is available in account number 1002-072-2906-3816.
APPROVALS:
The Roads and Drainage and Business Development Divisions concur with this recommendation.
REMARKS:
Three bids were received in response to this Invitation for Bids (IFB) and were evaluated for responsiveness, responsibility, and price reasonableness. Price reasonableness was established by comparison to the engineer's estimate and consideration of market factors. A scope meeting was conducted, during which the bidder confirmed their understanding of the scope of work and expressed confidence in the pricing submitted. Mercon Construction Company was deemed non-responsive by the Procurement Division, based on the analysis provided by the Business Development Division, which identified that the M/WBE participation goal was not achieved, and sufficient good faith effort documentation was not provided. M/S Sietricon was deemed non-responsive for failure to provide required documents and bid bond as prescribed in the IFB. A timely protest was filed by Mercon Construction Company. In accordance with the Procurement Ordinance, a protest review was held by the Procurement Manager on September 17, 2024, resulting in a decision to deny the protest. No appeals were received. American Persian Engineering and Construction LLC has a satisfactory record of performance for this type of work and has been determined to be responsible. Therefore, award is recommended to American Persian Engineering and Construction LLC.
