Approval and execution of 1) State of Florida Department of Transportation State-Funded Grant Agreement Termination by and between the State of Florida Department of Transportation and Orange County, Florida and 2) Resolution of the Orange County Board of County Commissioners regarding Termination Agreement (TA) with the State of Florida Department of Transportation (FDOT) for the FDOT State Funded Grant Agreement (SFGA) for FDOT Financial Project Number (FPN) 440429-2-34-01, Design of the West Orange Trail Phase 4B and authorization for the County Mayor or designee to execute any further necessary amendments to such Agreement that do not change the scope of the project or increase the overall project budget. PROJECT: N/A
PURPOSE: The Parks and Recreation Division is working with the Florida Department of Transportation (FDOT) to terminate the fully executed FDOT State Funded Grant Agreement (SFGA) for FDOT Financial Project Number (FPN) 440429-2-34-01 for the Design of the West Orange Trail Phase 4B (the “Trail”). The SFGA was fully executed on May 14, 2024, with a commitment of $640,080 in FDOT funds from a FY24 state legislative budget appropriation and $1,490,832 from Orange County funds.
The County moved forward with procuring an outside Design Consultant and WBQ Design and Engineering, Inc. (“WBQ”) was formally selected after a competitive bid process by the Board on March 25, 2025. While the County was in negotiations with WBQ on the final contract, critical agreements with the Florida Department of Environmental Protection (FDEP) for use of the Wekiwa Springs State Park (the “State Park”) for running the Trail were being pursued.
Before final execution of the contract, FDEP formally informed the County on February 26, 2026 of their rejection of the formal applications for use of the State Park property. As two-thirds of the proposed Trail would utilize the State Park property, the project was no longer feasible. The County has commenced cancellation of the contract with WBQ. FDOT advised the SFGA needs to also be terminated and forwarded the subject Termination Agreement.
The County Attorney's Office, Risk Management Division, and Parks and Recreation Division have reviewed this Agreement and find it acceptable.
