REMARKS: The Orange County Clerk of Courts, Comptroller Division, and the Regional History Center have occupied the leased premises since 2001. The current lease expired May 31, 2026, and the agencies continue to occupy the property under a holdover tenancy.

The three agencies currently occupy approximately 118,227 square feet of warehouse and office space. While relocation options have been explored, no suitable space is available to accommodate the operational needs of all three agencies. A five-year renewal was negotiated to provide additional time to identify a suitable location and relocate the agencies.

The County Attorney’s Office and Risk Management Division reviewed the Fifth Amendment to Industrial Lease Agreement. The County Attorney’s Office finds the Fifth Amendment acceptable as to form. Risk Management Division identified concerns with certain language in the Fifth Amendment; however, after consideration of the operational need to maintain the current location while a suitable replacement location is identified, Risk Management Division made a business decision to proceed and recommends approval of the Fifth Amendment.

This Fifth Amendment also provides for a landlord contribution in the amount of $236,000 for tenant improvements to meet the operational needs of the agencies at no cost to Orange County.
