Selection of Dean, Ringers, Morgan & Lawton, PA, for Provision of Counsel Services for Labor Management Litigation, Request for Proposals Y24-1076-RM. Further request Board authorization for the Procurement Division to negotiate and execute a three-year contract within a budget not-to-exceed $900,000. Further request Board authorization for the Procurement Division to renew the contract for two additional one-year terms. PROCUREMENT:
This contract provides representation for the County in providing labor management legal counsel services to include, but not limited to, competent and cost-effective legal defense, appellate services, and any other related counterclaims and program services.
FUNDING:
The contract is funded from the Risk Management loss fund through a third-party administrator.
APPROVALS:
The Risk Management Division and Business Development Division concur with this recommendation.
REMARKS:
The program is administered by the Risk Manager and a third party administrator who are responsible for the initial investigation and evaluation of claims. The disposition of claims is made by the Risk Manager in conjunction with the Risk Management Committee, which consists of members appointed by the County. This includes claims defense litigation similar to that required by an insurance carrier or large self-insurer.
The program is a mechanism through which discrimination and other unlawful employment practices are settled, litigated, or denied. The firm shall represent the County in providing labor management legal counsel services, to include, but not limited to, competent and cost-effective legal defense, appellate services, and any other related counterclaims and program services.
Two proposals were received in response to this Request for Proposals (RFP). The Procurement Committee evaluated the proposals in accordance with the criteria set forth in the RFP. The proposal from Johnson Jackson, PLLC scored too low for Board consideration.
The Procurement Committee evaluated proposals on October 23, 2024. Commissioner Mayra Uribe was assigned to the Procurement Committee.
