PROJECT:

PURPOSE: To provide for access for the construction, operation, and maintenance of a new drainage pipe necessary to improve stormwater conveyance and resolve existing flooding issues.

REMARKS: The Roads and Drainage Division requested the acquisition of the subject property to facilitate installation of new drainage infrastructure intended to improve stormwater conveyance and address ongoing flooding along South Lake Mary Jane Road. The Board approved the Contract for Purchase and Sale on April 7, 2026.

The Sellers have subsequently requested additional time to vacate the property following the closing. Public Works desires to complete the acquisition within the current fiscal year and is agreeable to allowing the Sellers to remain in possession for a limited period following the closing.

These agreements permit the Sellers to remain in possession for an initial period of 90 days following closing and establishes terms and conditions governing their temporary occupancy. The Third Amendment also authorizes the Manager or Assistant Manager of the Real Estate Management Division to approve written extensions, provided the total holdover period does not exceed six months.
