PURPOSE:
The Hunter’s Creek Community Association (HCCA) performs supplemental maintenance on the unpaved portions of South Orange Blossom Trail (SR 500/441) adjacent to its development. This right-of-way is owned by and under the jurisdiction of the State of Florida. Pursuant to state requirements, a Memorandum of Agreement (MOA) with the Florida Department of Transportation (FDOT) was executed prior to performing any contractual maintenance activities within the FDOT right-of-way. FDOT is prohibited from entering into contractual maintenance agreements with non-governmental entities such as the HCCA.
To facilitate the continuation of this maintenance work, the HCCA has requested that Orange County (County) act on its behalf and enter into the required MOA with FDOT. The MOA delineates the responsibilities of each party regarding the performance of maintenance activities and the allocation of compensation related to the FDOT right-of-way. The County will be reimbursed through state funds budgeted for the maintenance of this portion of SR 500/441.
Additionally, a separate agreement between the County and the HCCA is required to specify the method by which the HCCA is compensated through the County for maintaining this section of the FDOT right-of-way. The Board approved this agreement on June 2, 2009. An amendment to the agreement with the HCCA was approved on December 13, 2016, and a second amendment was approved on February 7, 2023.
This Contract Renewal with the Florida Department of Transportation has been reviewed and approved by the County Attorney’s Office as to form.
