PROJECT: Impact Fees for Additions to Residential Homes Resolutions
PURPOSE: Orange County collects impact fees to provide necessary infrastructure to support new growth for transportation, schools, law enforcement, fire, and parks. At the September 10, 2024, Board meeting, staff will present an issue related to assessments for school impact fees and transportation impact fees for additions to residential homes.
The current School Impact Fee Ordinance became effective on April 1, 2021, and the current Transportation Impact Fee Ordinance became effective on December 5, 2021.These two ordinance updates introduced the concept of “tiering,” with fees generally increasing with the overall size of the structure. After adoption, the application of tiered assessments specifically for additions to residential homes was not coded properly in the County’s Land Development Management System (LDMS). This meant that a number of permits for residential improvements were not charged for the appropriate school and transportation impact fees. The process was corrected in Fall 2023, with new assessments leading to complaints from existing homeowners.
During the work session on September 10, 2024, staff will provide the background on the assessment oversight, the tiering process, an analysis of permits for residential additions, policy considerations, and staff recommendation.
