PROCUREMENT:

This amendment is associated with the Roadway Conceptual Analysis (RCA) for McCulloch Road from Ken Dixon Way (formerly known as Orion Drive) to N. Tanner Road. Dewberry Engineers, Inc. will perform additional services (noise analysis) to enhance the RCA to a Project Development & Environment (PD&E) Study.

                     The purpose of this task is to perform a Highway Traffic Noise analysis in support of the McCulloch Road RCA and PD&E documentation. This scope establishes expectations between the County and the Consultant for compliance with Florida Department of Transportation (FDOT) procedures and applicable federal and state regulations.

                     The Clean Waterways Act was signed into law in June 2024, which implemented new stormwater rules.  The rules included a grandfathering criterion, which involves public transportation projects having an approved study by June 2026. Grandfathering does not eliminate the requirements for environmental protections. We will still obtain a permit and are not bypassing environmental safeguards.

The grandfathering provisions intend to provide regulatory consistency and avoid reexamining projects that have already undergone environmental review and design under previously accepted criteria.  Accordingly, the project is not seeking to “avoid” stormwater treatment, but rather to implement a system that was previously evaluated, designed, and determined to provide reasonable assurance of compliance with applicable water quality standards.

                     The scope and man-hours provide what is needed to develop documentation to be a National Environmental Policy Act compliant study for use as part of the South Florida Water Management District permitting process.

                     This noise study follows FDOT PD&E guidelines, procedures, and applicable federal and state regulations. This project is located in District 5.

FUNDING:

Funding is available in account number 1023-072-5005-3110.

APPROVALS:

The Transportation Planning Division concurs with this recommendation.

REMARKS:

On September 22, 2020, the Board authorized the selection of Dewberry Engineers, Inc. and authorized negotiation and execution of a contract by the Procurement Division provided that the contract does not exceed the budget amount of $425,000.  The contract was executed on September 20, 2021, in the amount of $424,987.71.

Previous change orders and contract amendments are as follows:

Change Order No. 1:  Effective Date: 9/19/2022      Lump Sum Increase:  $14,769.02

Added the assessment/evaluation of the existing pavement condition.

Change Order No. 2:  Effective Date: 11/22/2022      Lump Sum Increase:  $4,136.58

Added an assessment of the existing pavement condition.

Amendment No.1 / Change Order No 3:  Effective Date: 11/02/2023      Lump Sum Increase:  $85,830.16

Added the Intersection Control Evaluation assessment of the existing pavement condition. Additionally, contract time was extended for an additional 314 days to June 30, 2024.

Change Order No. 4 Effective Date: 01/06/2025     Lump Sum Increase:  $0.00

Contract time was extended for an additional 541 days to December 23, 2025. No funds added.

Change Order No. 5 Effective Date: 11/02/2025     Lump Sum Increase:  $71,647.78

Increased the scope to develop RCA to be a NEPA-compliant document for use as part of the St. Johns River Water Management District permitting in the amount of $71,647.75. Contract time was extended for an additional 373 days to December 31, 2026.
