Approval and execution of (1) Orange County, Florida and The Nemours Foundation Agreement related to Provision of Physical and Mental Wellness Support and (2) Business Associate Agreement between Orange County, Florida and The Nemours Foundation related to Provision of Adequate Assurances of Compliance with the Health Insurance Portability and Accountability Act (“HIPAA”) Privacy, Breach, and Security Rules, the Health Information Technology for Economic Health Act (“HITECH”) Breach Notification Rules, and the Florida Information Protection Act of 2014 (“FIPA”). PURPOSE: The Head Start Division requests Board approval and execution of the Agreement and addendum related to the Business Associate Agreement (BAA) between Orange County, Florida and The Nemours Foundation for the provision of physical and mental wellness support services, specifically the delivery of vision and hearing screenings to enrolled Head Start Children.
These screenings support the County’s efforts to promote early identification of potential health concerns and ensure children and families receive timely access to preventive wellness services. The agreement outlines all service expectations, documentation requirements, compliance obligations, and the term of service. The term of the contract is from October 1, 2026 through September 30, 2027.
The agreement also includes a delegation of authority, whereby the Board authorizes the Director of the Community and Family Services Department to execute any renewals of the Agreement, provided such renewals remain under the same terms and conditions. This authority also includes signing necessary amendments to the List of Participating Program Locations.
The County Attorney’s Office and Risk Management Division have reviewed the agreement for legal sufficiency and compliance with County requirements.
