Approval and execution of Seventh Amendment to The Cypress Lake Alternative Water Supply Agreement by and between The Water Cooperative of Central Florida and, individually, its Member Governments, the City of St. Cloud, Tohopekaliga Water Authority, Orange County, and Polk County. PURPOSE: On August 30, 2011, the City of St. Cloud, Tohopekaliga Water Authority, and Polk County, all as member governments of The Water Cooperative of Central Florida (WCCF), and Orange County and the Central Florida Tourism Oversight District (CFTOD), formerly the Reedy Creek Improvement District, entered into an agreement captioned "Interlocal Agreement Amongst The Water Cooperative of Central Florida, Orange County and Reedy Creek Improvement District Relating to the Preliminary Design and Permitting of the Alternative Water Supply Project Known as the Cypress Lake Wellfield and Related Matters.”
Orange County subsequently became a member of the WCCF, CFTOD subsequently withdrew from the agreement, and six amendments have been approved. The agreement and amendments address obligations of the Cypress Lake alternative water supply project including project management and administration, financial obligations, land acquisition, design, permitting, bidding, and construction of assets.
This Seventh Amendment to the agreement provides for the addition of a new Phase III-Stage 8 with the following obligations: construction of production wells CL-5 and CL-6 (“Wells”), construction of a raw water main to connect the Wells, property acquisition for the Wells and easements for routing the raw water main, update to the hydraulic model and infrastructure cost estimate in the Water Wheeling Plan, consultant services for Well construction and raw water mains, and consultant services to prepare funding applications and reports. The total estimated cost of Phase III-Stage 8 is $18,400,000 of which 30%, or $5,520,000, is Orange County’s share. The project is expected to create a total of 30 million gallons per day (MGD) of finished water; Orange County’s share is 9 MGD, or 30% of the total. This Seventh Amendment increases the total overall project costs to $74,972,060.40; Orange County’s total share is $22,491,618.12.
The County Attorney’s Office and Risk Management Division reviewed the amendment and find it acceptable as to form. Utilities Department staff recommend approval.
