PROJECT:

PURPOSE: On August 6, 2019, Orange County entered into an agreement with Tavistock East Holdings, LLC (the “Developer”) to extend an existing 24-inch and 30-inch reclaimed water main approximately 4,660 linear feet (LF) and 4,100 LF, respectively, and for the Developer to provide a utility easement for access to and maintenance of the reclaimed water main.  The Developer secured Environmental Resource Permit No. 48-106948-P from the South Florida Water Management District (SFWMD), completed construction of the project, and submitted construction completion certification to SFWMD.  Ownership of the completed 30-inch reclaimed water main extension was transferred to the County on November 11, 2024. In 2026, the County was notified that the SFWMD permit for the project must be transferred to the County as the legal entity responsible for perpetual operation and maintenance of the permitted works.  SFWMD provided a Request for Transfer of Environmental Resource Permit to the Perpetual Operation and Maintenance Entity form to transfer the permit from the Developer to Orange County, Florida.

Approval of the transfer form will document the County’s acceptance of the SFWMD permit transfer and perpetual operation and maintenance responsibility for the permitted infrastructure as owner. The requested delegation to the Utilities Department Director will allow the Utilities Director to execute and submit the transfer form and related SFWMD documents and to take actions necessary or incidental to completing and administering the permit transfer and the County’s operation and maintenance responsibilities under the permit.

The County Attorney’s Office reviewed the transfer form and finds it acceptable as to form. Utilities Department staff recommends approval.
