Approval to award Invitation for Bids Y24-1110-GO, Orange County Infrastructure Repair and Replacement, to the low responsive and responsible bidders, Stage Door II, Inc, in the estimated contract award amount of $4,378,870 for a one-year term, and RMS Constructors Group, LLC, in the estimated contract award amount of $4,611,620 for a one-year term. Further request Board authorization for the Procurement Division to renew the contracts for two additional one-year terms. ([Public Works Department Roads and Drainage Division] Procurement Division)

PROCUREMENT:
The work performed shall consist of the removal and replacement of existing damaged infrastructure including sidewalks, curb, gutter, driveway approaches, and pedestrian ramps. On occasion, the work may consist of the construction of new sidewalk in areas where there is no previous sidewalk or removal of asphalt up to 4" deep, to include adding or removing excess soil to accommodate installation of 4" or 6" concrete to designated elevation. The projects are located in all districts.
FUNDING:
Funding is available in account number 1002-072-2906-3816.
APPROVALS:
The Roads and Drainage and Business Development Divisions concur with this recommendation.
REMARKS:
Five bids were received in response to this Invitation for Bids and were evaluated for responsiveness, responsibility, and price reasonableness. Condor Construction Corp. was deemed non-responsive by the Procurement Division, based on the analysis provided by the Business Development Division, which identified that the M/WBE participation goal was not achieved, and sufficient good faith effort documentation was not provided. A timely protest was filed by Condor Construction Corp. In accordance with the Procurement Ordinance, a protest review was held by the Procurement Manager on December 2, 2024, resulting in a decision to deny the protest. No appeals were received. Price reasonableness was established by comparison to the engineer's estimate and consideration of market factors. Stage Door II, Inc. and RMS Constructors Group, LLC have a satisfactory record of performance for this type of work and has been determined to be responsible. Therefore, award is recommended to Stage Door II, Inc. and RMS Constructors Group, LLC.
