PROJECT:
Hold Harmless and Indemnification Agreement Case # HHA-26-06-134 for Hamlin Planned Development - Unified Neighborhood Plan (PD-UNP) / A Portion of CCM-3 - Waterside at Hamlin (formerly known as Shaw Daniels Infrastructure) Development Plan (DP).

 

PURPOSE: On April 22, 2025, the Board approved a substantial change to the DP Project, CDR-22-01-011, to construct 113 multifamily residential dwelling units on 10.78 developable acres and to request four waivers from Orange County Code to reduce the Normal High Water Elevation (NHWE) setbacks for buildings, paving areas, and a pool, to reduce the building separation requirement, and to reduce the link-to-node ratio requirement.

Approval of CDR-22-01-011 was subject to those conditions established by the Board, including Condition of Approval #23 requiring that the subject property owner execute and record an Indemnification/Hold Harmless Agreement indemnifying the County from any damages and losses arising out of or related in any way to the activities or operations on or use of the subject improvements resulting from the County's granting of the waiver requests and to inform all interested parties that the multi-family buildings are located no closer than 35 feet from the NHWE of Lake Hancock and the parking, paving, and pools are located no closer than 5 feet from the NHWE of Lake Hancock.

Through this request, the applicant is seeking approval of a Hold Harmless and Indemnification Agreement which indemnifies Orange County from any damages caused by the County’s granting of the waiver requests and informs all interested parties that the proposed multi-family buildings are located no closer than 35 feet from the NHWE of Lake Hancock and the parking, paving, and pools are located no closer than 5 feet from the NHWE of Lake Hancock as stipulated by the Board on April 22, 2025 through Condition of Approval #23 as part of CDR-22-01-011.

This proposed agreement received a recommendation of approval from the Development Review Committee on July 8, 2026.
