PROJECT:
Amended and Restated Single Family Affordable Housing Developer’s Agreement with Habitat for Humanity Greater Orlando and Osceola County, Inc.

 

PURPOSE: On October 18, 2016, the Board approved a Developer's Agreement with Habitat for Humanity Greater Orlando and Osceola County, Inc. formerly known as Habitat for Humanity of Greater Orlando Area Inc., for the development of eight  affordable, fee simple, owner-occupied single-family homes on a property formerly operated as a dilapidated mobile home park in the Bithlo area (the “Project”). The Agreement conveyed properties to the Agency through the County's Foreclosed Properties Program via Resolution No. 2016-M-51. Due to unforeseen environmental conditions and higher than anticipated pre-development and site improvement costs, the Project experienced significant delays. In addition, two parcels were found to be affected by a flood hazard area, which created development constraints and reduced the number of units that could be feasibly constructed on the property from eight to six homes. As a result, an Amended and Restated Developer's Agreement needs to be executed to update and revise the project scope, project budget, performance requirements, and development timeline. The agreement has been reviewed by the County Attorney's Office as to form.
