PURPOSE: OC-IB II Property Owner, LLC (Owner) owns property in unincorporated Orange County that is contemplated for development with a number of improvements for various uses (Property), and Orlando Leased Housing Associates XIV, LLLP (Developer) is purchasing a portion of the Property from the Owner. The County will utilize an existing interconnection letter agreement with Tohopekaliga Water Authority to provide wastewater service to the Property while the Developer, on behalf of the Owner, constructs an 8-inch wastewater force main to redirect wastewater flow to the County’s wastewater treatment facility (Construction). The Developer holds sole responsibility for the total cost of the Construction, and as a condition of the County allowing the Developer to connect the Property to the County’s wastewater system prior to completion of the Construction, the Developer has agreed to post a surety in the form of a cash escrow in the amount of $4,792,560 to guarantee funds are available to secure the Developer’s obligation to pay for the Construction. 

The County Attorney’s Office and Risk Management Division reviewed the agreement and find it acceptable as to form. Utilities Department staff recommends approval.
