PURPOSE:
The attached Interlocal Agreement (ILA) concerning the Kirkman Road Extension is intended to memorialize the respective responsibilities of Orange County and the Shingle Creek Transit and Utility Community Development District (District) as it relates to the maintenance and operations of the Kirkman Road Extension. Pursuant to the Roadway and Infrastructure Agreement (Kirkman Road Extension - dated December 23, 2019), pertinent segments of the Extension (Segment 1 and Segment 2) are to be conveyed from Universal to Orange County (inclusive of transit and ancillary infrastructure). Thereafter, the applicable sections of the road will then comprise part of the County public roadway system.
Upon conveyance of Kirkman Road to the County, the District will assume inspection and maintenance services for the management, operations, and maintenance of the aesthetic components of the infrastructure as defined in Exhibit C of the ILA. The cost of the aesthetic inspection and maintenance services are to be borne solely by the District.
Similarly, the District is to also assume inspection and maintenance service for the structural elements of the infrastructure (identified in Exhibit D of the ILA).
