PURPOSE: Orange County and the Reedy Creek Improvement District (RCID) entered into the Reedy Creek Improvement District/Orange County Amended and Restated Water, Wastewater, and Reclaimed Water Service Territorial Agreement (Agreement) on September 30, 2008; amended the Agreement on November 14, 2018; and further altered RCID’s Territorial Area through the Territorial Boundary Adjustment Agreement (Adjustment Agreement) on December 6, 2022. In 2023, RCID was renamed the Central Florida Tourism Oversight District (CFTOD) by Chapter 2023-5, Laws of Florida. 

CFTOD requested a second amendment to the Agreement to transfer a portion of CFTOD’s territory greater than 50 acres into Orange County Utilities’ territory.  This second amendment also changes the name of the Agreement to Amended and Restated Water, Wastewater, and Reclaimed Water Service Territorial Agreement; and replaces RCID with CFTOD in the Agreement and Adjustment Agreement unless context requires otherwise. 

The County Attorney’s Office and Risk Management Division reviewed the agreement and find it acceptable as to form. Utilities Department staff recommends approval.
