PURPOSE: To provide the Grantor (or assigns) reserved rights to construct and maintain boat docks on 14 privately owned lots, subject to further permitting, pursuant to Chapter 15, Article IX (Dock Construction Ordinance).

REMARKS: On December 6, 2013, the Environmental Protection Division (EPD) issued Conservation Area Impact Permit CAI-13-02-002 (Permit). The permit authorized impacts to 3.87 acres of Class III wetlands in order to construct a subdivision. Mitigation included the preservation of 44.65 acres of onsite wetlands and the purchase of 0.27 credit from the Southport Ranch Mitigation Bank. The authorized wetland impacts were completed, the Conservation Easement (CE) was recorded, and mitigation credits were purchased, as required by the Permit
On April 19, 2021, EPD received a request to modify the permit to remove 3.55 acres of the on-site wetland preservation to allow for private boat docks on Lots 294-296 and Lots 340-350 (collectively, the "Adjacent Lots").
