2026 Transportation Impact Fee Study Update. (Transportation Planning Division)

PURPOSE:
Orange County collects impact fees to help fund the infrastructure necessary to support newly approved growth and mitigate impacts to transportation, schools, law enforcement, fire, and parks. Pursuant to Orange County Code, Sec. 23-99, the County shall review the transportation impact fee technical study and code every five years to review and update construction costs, identify necessary transportation improvements, and ensure that impact fees do not exceed a development’s proportionate share of the reasonably anticipated costs attributable to new growth. The currently adopted transportation impact fee study is dated September 11, 2020, with the last amendment to the Code on June 30, 2021.
The County engaged its consultant in December 2025 to update the transportation impact fee technical study and ordinance. The consultant’s draft technical report is attached. During the work session on June 16, 2026, staff will review the draft results from the study and seek Board direction on major policy issues that will need to be resolved prior to completion of the final technical study and ordinance update. Staff will also provide the Board with an overview of the next steps required for adoption.
