PURPOSE: On September 30, 1985, Orange County, Shell Oil Company, and Westinghouse Electric Corporation entered into the Orange County-Shell Oil Company Interim Wastewater Facilities Agreement Contract S-85-16 for Shell Oil Company to design, permit, and construct interim wastewater facilities to serve wastewater to property then owned by Westinghouse.  In 2007, the property was sold to GPO UCC LLC (“Current Owner”), who recently requested to release the property from the original agreement.  Utilities confirmed the property was developed in 2003 and subsequently connected to the County’s wastewater facilities at the time of the development.  This Partial Release of Interim Wastewater Facilities Agreement will release the Current Owner’s property from the original agreement, and the Current Owner will record the partial release in the Public Records of Orange County. 

The County Attorney’s Office and Risk Management Division reviewed the partial release and find it acceptable as to form. Utilities Department staff recommends approval.
