Consent Agenda - November 19, 2024 Custodial Agreement (Excess TDT Revenues) among the University of Central Florida Board of Trustees, UCF Stadium Corporation, and The Bank of New York Mellon Trust Company, N.A., as Custodian

 

PURPOSE: On May 21, 2024, the Board approved a funding agreement among Orange County, the University of Central Florida (UCF) Board of Trustees, and the UCF Stadium Corporation, Inc. which provided $10 million per year for nine years ($90 million) from excess Tourist Development Tax (TDT) revenues for the UCF Stadium Tower Project. Under the terms of the approved Funding Agreement, UCF is required to establish a custodial account which would receive the County’s Excess TDT contribution and make the eligible distributions for the Stadium Tower Project, subject to the terms of a Custodian Agreement which is subject to prior County review and approval. Staff from Fiscal & Business Services, County Attorney’s Office, and the Comptroller’s Office worked with UCF on the terms of the Custodian Agreement.
