PURPOSE: To provide for the termination of an unrecorded Conservation Easement Agreement.

REMARKS: On April 8, 2025, the Board approved a Conservation Easement Agreement (“Agreement”) as required by Specific Condition 8 of Conservation Area Impact Permit No. CAI-23-10-047 (“Permit”).  

On September 29, 2025, the property owner sent a request to the Environmental Protection Division (EPD) to close the Permit, and on October 16, 2025, EPD closed the Permit. This action terminates the unrecorded Agreement since the underlying project is no longer moving forward, and the Permit has been closed. Owner to pay recording fees.
