Approval and execution of Agreement for the Delivery and Use of Reclaimed Water (Hartzog Road Attainable Housing) by and between Orange County, Florida and HRAHC LANDLORD, LLC. District 1. (Engineering Division)

PURPOSE: The agreement between Orange County and HRAHC LANDLORD, LLC (the “Owner”) is for the use of reclaimed water to irrigate portions of the Owner’s property. The total anticipated average annual volume is 116,728 gallons per day. Provisions of the agreement require the Owner to use reclaimed water as its primary source of irrigation in accordance with applicable rules and regulations of the County, Florida Department of Environmental Protection, and the applicable Water Management District, and payment of monthly charges in accordance with County rate resolutions. The agreement is for a 10-year term with automatic one-year renewals.
The County Attorney’s Office and Risk Management Division reviewed the agreement and find it acceptable as to form. Utilities Department staff recommends approval.
