PROJECT:

PURPOSE: A new interchange is being constructed at the intersection of the Florida Turnpike and Sand Lake Road.  Due to this construction, Orange County Utilities (OCU) is relocating and reconstructing a portion of its force main that will cross an existing Florida Gas Transmission (FGT) easement within the road right-of-way.  FGT requires an Encroachment Agreement (Agreement) specifying the conditions, engineering, and construction terms for the relocation. This Agreement meets FGT’s requirements and will allow OCU to construct, operate, and maintain the utility infrastructure improvements within the existing FGT encroachment area in accordance with the terms and conditions of the Agreement.  

The County Attorney’s Office and Risk Management Division have reviewed the agreement.  The County Attorney’s Office finds it acceptable as to form. Risk Management does not agree with the language as written in the Agreement, but understands the Agreement must proceed in order to avoid a contract claim.  Utilities Department staff has reviewed the agreement and made a business decision to move forward and recommends approval.
