PURPOSE: Providing comprehensive environmental monitoring of the natural resources within Orange County requires a collaborative effort between the Utilities Department (OCU) and the Planning, Environmental, and Development Services Department (PEDS).  In accordance with a 2004 Memorandum of Agreement, the OCU Water Laboratory provided analytical testing and reporting services in support of the regulatory and permit requirements of the PEDS Environmental Protection Division; however, the existing agreement expires on September 30, 2024.  OCU and PEDS are requesting Board approval for this Memorandum of Understanding for Laboratory Testing Services to replace the existing agreement with updated scope of services and financial responsibilities for a five-year term through September 30, 2029. 

The County Attorney’s Office and Risk Management Division reviewed the agreement and find it acceptable as to form.  Utilities Department staff recommends approval.
