PROJECT: Affordable Housing Impact Fee Exemption Program
PURPOSE: In 2021, the County amended various sections of County Code related to residential impact fees to provide for impact fee exemptions for certified affordable housing projects. Currently, the County provides residential impact fee exemptions for certified affordable housing projects at a rate of 100 percent. The Affordable Housing Impact Fee Exemption Program has been successful in incentivizing the development of affordable housing; however, the success raised concerns with the County and Orange County Public School's ability to finance infrastructure needs. Because of this, in 2024, County Administration directed staff to update the impact fee exemption program to allow for a more equitable exemption of impact fees based on updated program criteria while ensuring adequate infrastructure capital is provided for future needs.
The Housing and Community Development Division held several meetings this year with the affordable housing development community, Orange County Public Schools, and the City of Orlando to seek input and review the updated Affordable Housing Impact Fee Exemption Program.
