PURPOSE:
The Roadway Agreement Committee has reviewed a Right of Way and Transportation Impact Fee Agreement Sutton Lakes PD Avalon Road (C.R. 545) ("Agreement") by and between Westgate Resorts, Ltd. and Orange County for the dedication of right-of-way and pond site for the road widening project on Avalon Road (C.R. 545) from Hartzog Road to U.S. 192. Within 120 days of the effective date of this Agreement, Westgate Resorts, Ltd. shall convey 1.404 acres of right-of-way and a 4.337 acre right of way pond parcel by general warranty deed or plat. The agreed-upon fair market value of the property is $2,471,961.38 ($430,580.28 per acre) however, due to an existing underground utility improvement, the Parties have agreed to reduce the compensation of the Conveyed Lands by $440,746.80. Therefore, for the dedication of right-of-way and right-of-way pond parcel for Avalon Road (C.R. 545), the Owner will receive a total of $2,031,214.58 in transportation impact fee credits.

The Roadway Agreement Committee recommended approval of the Agreement on December 11, 2024.
