PROJECT: Mobile Temporary Overnight Shelters (MTOS) Fee Resolution
PURPOSE:
The consideration of this fee resolution will run concurrently with the second of two required public hearings to consider an ordinance amending several sections of Chapter 38 of the Orange County Code related to the parking of overnight buses or a Mobile Temporary Overnight Shelter (MTOS), supporting homeless shelters and transitional service providers.
The proposed ordinance will amend Section 38-1 (“Definitions”) and 38-77 (“Use Table) as well as create a subsection 38-79(9) (“Conditions for permitted uses, special exceptions”) of Chapter 38 (“Zoning”) of Orange County Code. The amendment would create a definition for an MTOS, establish MTOS as a use permitted in the zoning code, and establish operational standards for the use.
With the adoption of this new use and standards associated with the use, a permit will be required to ensure that the proposed use is in compliance with code. The proposed fee will be applied to applications requesting MTOS approval, which will include application and site plan review, and distance separation measurements.
