County’s Intergovernmental Reimbursement Agreement with the U.S. Marshals Service regarding  
federal inmates housed in County, as well as the County’s engagement with U.S. Immigration and  
Customs Enforcement; and further, County Attorney Jeffrey Newton, provided an update on the  
potential litigation related to the agreement of Delegation of Immigration Authority under Section  
287(g). Board discussion ensued.

negotiate and execute a contract in the budget not to exceed $2,200,000 for Phase 1; and further,  
authorize the Procurement Division to formally terminate negotiations with the top ranked firm, if  
we are unable to come to a favorable negotiated agreement, and commence negotiations with  
the next ranked alternate, until a successful negotiation is reached. The motion carried by the
